Learn What Trademarks Do

A trademark is any word, name, symbol, or device that identifies a product’s origin and distinguishes it from others in the market. Meanwhile, a service mark performs the same purposes but for services instead of goods. Both terms are commonly referred to as “trademark” and “mark.”

Trademark rights afford you and your product or service a layer of protection. However, the registration process, especially when dealing with the USPTO for interstate or foreign commerce marks, demands the legal precision and knowledge that a trademark attorney offers.

Find Out More about the Trademark Identification Manual

The IDML defines the 34 classes for goods and 11 for services. A mark must be identified with at least one class.

Related Fees

Each identified class on a mark has a USPTO fee. Trademark Electronic Application System (TEAS) Standard filing requires $350 per good or service class. Meanwhile, TEAS Plus filing requires $250 per good or service class but has more requirements.

Read More about the Trademark Manual of Examining Procedure

TMEP offers a comprehensive guide to prosecuting trademark registration applications in the USPTO. Trademark examiners, applicants, and attorneys or representatives of applicants can use this manual as a reference on the registration process’s practices and procedures.
